to protect state and public interests, the procuratorial authorities of the Rovno region initiated the termination in court illegal use of the property GUZ "Rivne higher vocational school of restaurant service and trade" value of over UAH 460 thousand. We are talking about part of the premises of the educational institution with an area of 212 sq m, which is a Department of the state property Fund of Ukraine in Rivne region, in violation of the law was transferred in rent to one of societies with limited liability for purposes connected with repair and finishing of metal products. The court of first instance in satisfaction of the claim of the public Prosecutor about the termination between the parties to the lease and return the premises to an educational institution was denied. However, this court decision, the Prosecutor's office fundamentally disagreed and challenged it in appeal. As a result of consideration of the complaint of Prosecutor's office of Rivne region, Rivne economic court of appeal recognized the reasonableness of the position that the premises were used contrary to the requirements of article 63 of the law of Ukraine "On education" not on purpose, that is not for educational process or educational purposes, and therefore 03.05.2017 decided to cancel the illegal decision of the court of first instance to annul the lease of the space and return it to school. Thus, due to prosecutorial interference with the property of the school will be used in the future in the interests of the students.
