In the Ternopil region from now on in the village,town and city councils will have their own labor inspectors
In connection with the reform of decentralization and the fact that powers are delegated to a place, village, town and city councils of the United territorial communities will have their labor inspectors. They do not need any permits for audits of legal entities and individuals that use hired labor, and they carry out these checks in the form of inspection visits and on-site inspections. So, according to the head of Department Gastrula of Ukraine in Ternopil region Natalia brown, now there is a transition to a new order of control over observance of labor legislation. The corresponding decree approved by the Cabinet, came into force on 26 April this year. In particular, the conviction of Natalia Rus, this procedure can significantly improve the effectiveness of control measures on elimination of undeclared work and of course will positively affect the pay status of employees. "This innovation provides for the decentralization of powers in the area of the controlling authority on compliance of labour legislation. The state is partly transferred to the Executive bodies of city councils of cities of regional importance, village and city councils of the United territorial community, the implementation in the respective territories of control over observance of legislation on labour and employment and the imposition of fines for violation of legislation on labour and employment in the order established by the legislation", – said Natalia Rus. At the same time, she noted that the local authorities desire to have a staff of state labour inspectors, Supervisory powers which will be confirmed by official Ministry certificate of prescribed form, which seems Gastrula. Grounds for issue of the certificate of the inspector of labour official of the Executive body of the Council is a letter to rural, settlement, city mayor, to which is attached a completed map based on the data of the labour inspector according to the form approved by Minsotspolitiki. "In connection with these changes the inspector can make decisions about inspection visits or field inspections by labour inspectors in case of legal entities, including their structural and subdivisions are not legal entities and physical persons which use wage labor. Now only if the identity inspector, as an official, will have the right to go to the entity and to verify facts that are within his powers. In particular, is entrusted to the three main blocks – observance of minimum guarantees of remuneration, ensuring the human right to safe conditions of work and payment for this work, and to identify illegal employment. It is for these three positions measures will be taken at the same time making prescriptions. As for the Control Gastrula it, in addition to its direct function, also will carry out supervision over the observance of labor legislation the relevant local authorities. In fact, to the approval of the Ministry of social policy of Ukraine forms the identity of the labour inspector, issuing the certificates and entering them in the register of certificates of inspectors of labour all the checks on compliance with labor laws is suspended", – said Natalia Rus.
