8 July this year in Ukraine will increase the minimum size of the alimony on the child. This informs the Regional centre for providing free secondary legal aid in Zhitomir area. "If earlier the minimum amount of support was 30%, with the 8 July 2017 the minimum size of the alimony on one child may not be less than 50% of the subsistence minimum for a child of appropriate age" – say representatives of the Regional centre. In addition, according to them, changes significantly the approach to additional expenses for the child. If addressing the court in the case of recovery of additional costs for a child, it was necessary to pay a court fee, and now court fees not already paid. Previously such claims were submitted at the place of residence of the defendant. Now this situation is changing and you can sue at the place of residence of the plaintiff. In determining the amount of alimony the court will take into account hidden income of the maintenance payer. The Law also establishes the right of the parent with whom the child lives to determine how to enforce child support and obtain in the order of summary judgment alimony in the amount for one child – one quarter, on two children – one thirds, on three and more children – half of earnings (income) of the payer of the alimony, but no more than ten times the subsistence minimum per child of appropriate age in the case of determining the amount of alimony as a share of the earnings (income) of the mother, the father of the child, or in the amount of fifty percent of the subsistence minimum for a child of the relevant age, if the stated requirement on indexation of the alimony, awarded in fixed amounts. Under the old legislation, the alimony received on the child was the property of the parents, the name of whom they were paid, and should be used for the intended purpose. Now the alimony received on the child, is the property of the child, she has the right to participate in the use or to dispose of the alimony on its maintenance according to the Civil code of Ukraine.
