Chernivtsi: the List of companies that do not have licenses to operate hazardous waste
With the aim to control and prevent the implementation of unlicensed activity, the published list of entities for which the Ministry of environment adopted the decision on cancellation of licenses for economic activities for the management of hazardous waste. PERELIK Reference: According to article 16 of the law of Ukraine "On licensing of types of economic activity" (further – the Law) the revocation of a license is deprivation of the licensee of the right to exercise the type of economic activity subject to licensing, approved by the licensing authority decision to cancel its license. The meaning of the ninth article of the said Law, if the licensee during the term of the entry into force of the decision of the licensing authority to revoke the license files a complaint (appeal) to the Expert and appeal Council on licensing, the effect of this decision of the licensing authority is suspended until a decision by the specially authorized body on licensing issues according to the results of consideration of the appeal the Expert-appeal Board on licensing issues. Given the letter of the Ministry of justice of Ukraine regarding the validity of the orders of the Ministry of natural resources about cancellation of licenses in the field of hazardous waste management, we note that the effect of this limit on the suspension of the decision of the licensing authority to revoke the license ends with the entry into force of the decision of a specially authorized body on licensing issues to grant the appeal or dismiss the appeal, elimination of violations of legislation in the sphere of licensing by results of consideration of the appeal the Expert-appeal Board on licensing issues. Other provisions limiting the effect of the decision of the licensing authority to revoke the license, the Law does not contain. Therefore, given the content of the ninth paragraph of article 16 of the Law, from the date of the decision of the State regulatory service of Ukraine by results of consideration of the complaint at the time of cancellation of the order of the Ministry of natural resources, the license of the corresponding subject of licensing is cancelled.
