the Prosecutor's office will appeal against in a cassation order the decision of the court of appeal of Volyn region as of August 9, 2016, which upheld the sentence of Lutsk city district court 37-year-old resident of the village Slanec Lutsk district who shot son-in-law. On the evening of 15 January 2016, being in a state of alcoholic SP’intoxication in his garage, a man quarreled with a relative and shot him with a hunting rifle. The bullet hit the victim in the stomach. To re-shots, the attacker was prevented by his mother, who in time came to the scene. After the crime, the man surrendered to the police and gave the crime tool. During a pretrial investigation, he sincerely repented and actively contributed to solving the crime, therefore, Lutsk city district court, finding him guilty of grievous bodily harm, and sentenced him to six and a half years of imprisonment. According to the court verdict from the convicted person must also be recovered in favor of the victim from the crime of property damage in the amount of 74 000 UAH. and moral damages in the amount of 150 000 UAH. as well as costs incurred for legal assistance in the amount of 5000 UAH. Despite the fact that the court of appeal upheld the sentence of Lutsk city district court, prosecutors in the cassation instance will insist on a revision of the decision of the court in connection’connection with wrong application of the criminal law and m'quality of the punishment.
