The Prosecutor's office of Rivne region prevented groundless recover from the state budget of over 305 thousand UAH
taking into account the position of the Prosecutor of the Rivne region by the decision of economic court of Rivne region 20.02.2017 denied one of societies with limited liability in the claim about collecting from the Department of health of Rivne regional state administration, over 305 thousand UAH. We are talking about the means of VAT, which the company tried to collect in a judicial order for delivered to the office of 7 x-ray machines, with a total value of 4.7 million UAH according to the contract on public procurement. To protect the interests of the state and to prevent arbitrary collection of funds from the budget of the Prosecutor's office of Rivne oblast have implemented entry into said case. In court, the Prosecutor proved the illegality of the requirements of the companies as at the date of consideration and resolution of this dispute the obligation to pay VAT from the plaintiff arose, and duty, which will be assessed tax, does not exist. As a result, the court came to the conclusion about the absence of grounds for recovery of funds and its decision to satisfy the requirements of the companies refused.
