In Rivne region law enforcement officer convicted of divulging state secrets,
the Prosecutor's office of Rivne region participated in the judicial review of indictment in respect of the employee of law enforcement agencies, who committed a crime in the sphere of protecting state secrets. Pre-trial investigation is established and proved in court that 38-year-old militiaman, being a person who has been granted admission to the state secret, acting intentionally, contrary to the interests of the service and the requirements of the legislation leaked to a natural person the information that was entrusted to him and is known in connection with the performance of official duties and state secret. The disclosure by a law enforcement authority specified information entailed heavy consequences. During pre-trial investigation, the suspect concluded with the Prosecutor a plea agreement of guilt of a criminal offense under article 328 of the criminal code (disclosing state secrets). Rivne city court agreed with the position of the Prosecutor, found the man guilty of a crime and has appointed punishment in the form of deprivation of liberty for a term of 5 years with deprivation of the right to occupy posts in public authorities, local governments and law enforcement for a period of 3 years. At the same time, given the fact that the defendant fully admitted his guilt and sincerely repented to him by the court applied article 75 of the criminal code of Ukraine and released from serving the basic punishment with a probationary period of 2 years from the laying of certain duties.
